Richard J. Curiale

Partner

Richard Curiale is the Managing Partner of Curiale Hirschfeld Kraemer LLP. He is resident  in the firm’s San Francisco, California office.  In addition to spending a significant amount of time litigating employment disputes, Mr. Curiale also focuses a major part of his practice on  supervisory training, preventive labor relations, union organizing, collective bargaining and arbitration.  He regularly presents public and in-house seminars designed to teach managers and supervisors how to avoid costly litigation, particularly in the areas of wrongful discharge, discrimination and sexual harassment.  He has made numerous presentations to Fortune 500 companies throughout the country, as well as to the California court system.  Mr. Curiale regularly represents employers who have been charged with wrongful termination, discrimination or sexual harassment.  He also advises employers on how to respond to union organizing, represents companies before the National Labor Relations Board, at the bargaining table and also advises companies on NLRB organizing and decertification procedures. 

Representative Matters

Successfully defended wrongful termination/retaliation claims against a major technology company and one of the company’s officers. After a 20-day jury trial, received a complete defense verdict on all claims

Successfully defended a major company before the NLRB that was accused of terminating numerous employees for union activity during an organizing campaign. All charges were dismissed and the election was upheld

Successfully defended a high tech company against a claim of retaliation and defamation. After two days of testimony and one day of cross examination before a jury, the plaintiff withdrew his claim with prejudice

Successfully trained over 2000 managers, supervisors and employees in 2007 – 2008 throughout California and in many other states on numerous topics including Managing Within the Law, Conducting an Effective Internal Investigation of Employee Complaints, Eliminating Sexual Harassment and Managing Effectively Under a Collective Bargaining Agreement
